JOB PURPOSE:
- The Senior Legal Counsel of Heineken Vietnam (the “Company”) shall provide efficient and high-quality legal services to the Company.
- The Senior Legal Counsel will be acted as trusted legal business partner for sales and marketing team (“Commerce”) and shall be responsible for providing a broad range of legal advice and support to the Commerce, including with respect to commercial operations, to (1) enable the Company to avoid and manage legal risks and (2) ensure compliance of the Commerce's activities with Heineken’s Code of Business Conduct and policies, applicable laws and regulations.
KEY RESPONSIBILITY:
- Acting as trusted legal business partner for Commerce and responsible and oversee all legal issues for operations of Commerce.
- Responsible for fostering an ethic and compliance culture within the company including but not limited to compliance with anti-trust, anti-corruption, and data privacy and various the group policies, regulations and industry code and ethics.
- Advising the legal strategy and legal supports on product claims, product liability, competitor challenges and defenses and be assertive to challenge the unfair or incompliance business practices of competitors.
- Providing pragmatic and commercially sound legal solutions and advisory to business stakeholders and senior management and day to day support on drafting, reviewing, and negotiating a wide range of commercial contracts for daily operation activities.
- Contributing to the realization of the Company’s objectives by providing high quality, solution-oriented and cost-effective legal services.
- Proactively identifying, evaluating, and advising Commerce’s stakeholders on areas of legal risks (prevention and management of legal risks) and opportunities.
- Helping to ensure compliance with the Heineken Group’s Code of Business Conduct and policies and foster an environment of teamwork and collaboration.
- Keeping abreast of changes in laws and regulations that affect company operations and effectively communicate such change to the relevant stakeholders and provide necessary trainings to business and support functions.
- Driving accountability and ownership in the Legal function to deliver high quality legal support to business partners and other stakeholders with optimal cost structures.
- Other tasks or projects may be assigned by Head of Legal or Regional Legal Head.
REQUIREMENT:
- Requires a law degree or LLM in commerce or economic law.
- Lawyer qualification over 10 years legal experience, preferably solid in-house counsel experience with a multi-national FMCG corporation or a combination of experience as private practice attorney and as an in-house counsel.
- Previous experience in an MNC or a highly complex organization in FMCG industry would be highly advantageous.
- Strong communication and stakeholder management capabilities, high level of collaboration and influence cross-culturally.
- In-depth legal knowledge (including commercial law, corporate law, investment law, anti-bribery law, civil law, data privacy law, alcohol law, advertisement law and any other relevant laws and regulations).
- Strong problem-solving, decision-making and risk assessment capabilities, with good judgment and commitment to delivering results.
- Energizing and inspiring others to go beyond the norm and actively contribute to delivering critical commercial objectives.
